Terms & Conditions

1.1In these general terms and conditions, the following definitions apply:

• BigBeads: the private limited company BigBeads B.V., established in Schijndel.
• Client: any natural or legal person who enters into an agreement with BigBeads.
• Products: all goods and services offered and supplied by BigBeads, including bespoke interior products such as bead curtains, installations and other interior applications.
• Bespoke: any product made to the client's specification, including but not limited to dimensions, colours, patterns, designs, material variants or specific technical execution.
• In writing: communication by email, letter or other electronic means.

2.1These general terms and conditions apply to all quotations, agreements, deliveries and services of BigBeads, unless otherwise agreed in writing.

2.2By placing an order, the client accepts these general terms and conditions.

3.1All quotations and offers from BigBeads are non-binding and valid for 30 days, unless stated otherwise in writing.

3.2BigBeads reserves the right to amend or withdraw offers.

3.3BigBeads is not bound by price or product information that is demonstrably based on errors.

4.1All prices exclude VAT and any transport, installation or travel costs, unless stated otherwise in writing.

4.2For orders with a total value below € 2,000, the full invoice amount must be paid in advance, unless otherwise agreed in writing.

4.3For all other orders, a 50% deposit is required upon ordering. The remaining amount must be paid no later than 14 days after delivery.

4.4Production, delivery and/or installation will only start once the required payment has been received in full. Any delays caused by late payment are entirely the client's responsibility and do not constitute grounds for compensation.

4.5In the event of late payment, the client owes statutory interest and all collection costs are borne entirely by the client. BigBeads has the right to suspend delivery until payment has been received.

5.1The client is responsible for providing correct measurements and technical data, and for the suitability of the mounting location.

5.2If BigBeads takes the measurements itself, only these measurements serve as the basis.

5.3BigBeads is not liable for damage, delay or incorrect execution resulting from incorrect measurements or unsuitable walls, ceilings or structural conditions.

6.1Delivery takes place within an agreed period. All delivery times are indicative and are not strict deadlines.

6.2Delivery periods only commence once the required payment has been received.

6.3BigBeads is not liable for delays caused by force majeure, strikes, production constraints, transport problems, shortcomings of suppliers or construction delays on the client's side.

6.4The risk of loss, damage or theft of products passes to the client upon delivery.

7.1All delivered products remain the property of BigBeads until full payment has been made.

7.2Until that moment, the client may not pledge or otherwise encumber the products.

7.3BigBeads retains the right to reclaim delivered products if payment is not made, wherever they are located.

8.1BigBeads provides a 2-year warranty on manufacturing and material defects, calculated from the date of delivery.

8.2The warranty does not apply in cases of improper use, normal wear and tear, damage caused by moisture, sunlight, installation by third parties or accidents.

8.3Colour and material nuances, slight dimensional differences and production tolerances within normal margins do not constitute a defect and are not grounds for complaint.

8.4Complaints must be reported in writing within 14 days of delivery.

9.1The statutory right of withdrawal does not apply to bespoke products, in accordance with Article 6:230p(f) of the Dutch Civil Code.

9.2For standard products, the client has the right of withdrawal within 14 days of delivery, with return costs borne by the client.

10.1If BigBeads carries out the installation, a safe and suitable suspension system is guaranteed.

10.2If the client installs the products themselves or engages third parties, BigBeads accepts no liability for damage, accidents or improper use.

10.3Additional installation work due to deviating structural conditions or incorrectly supplied measurements may be charged.

11.1Cancellation of an order must be made in writing.

11.2Standard products may be cancelled free of charge within 7 days.

11.3When cancelling a bespoke order, the client must fully reimburse all costs incurred, including preparation costs, design costs, measuring, material orders, reserved production time and other related costs.

11.4Changes to bespoke orders may result in additional costs and longer delivery times.

12.1If the client does not provide the necessary information, measurements, technical data or cooperation in time, BigBeads has the right to suspend delivery, production or installation without liability for any delay.

13.1All designs, images, patterns, texts, technical drawings, installation methods and other creations of BigBeads are the property of BigBeads.

13.2Copying, distributing, commercial use or reproduction without prior written consent is prohibited.

14.1BigBeads is not liable for damage caused by force majeure, including natural disasters, pandemics, government measures, external supplier problems, transport restrictions or other circumstances beyond its control.

14.2In the event of force majeure, BigBeads has the right to suspend or terminate the agreement without compensation.

15.1BigBeads is only liable for direct damage resulting from a demonstrable defect in the product or installation.

15.2BigBeads is never liable for consequential damage, such as loss of income, downtime, loss of profit or damage to the client's property.

15.3The liability of BigBeads is limited to a maximum of the invoice amount of the delivery concerned.

16.1BigBeads processes personal data in accordance with the GDPR. The privacy policy is available on the website. See our privacy policy.

16.2Personal data is used only for processing orders, service and improving our services.

16.3Data is not shared with third parties unless necessary for the performance of the agreement or required by law.

16.4Clients have the right to access, correct and delete their data.

16.5BigBeads takes appropriate security measures against unauthorised access, loss or theft.

17.1Dutch law applies to all agreements and deliveries.

17.2Disputes will be submitted to the competent court in the district where BigBeads is established.
